These Terms of Service (“Terms”) govern your access to and use of the Site, its content, products, and services. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Site on behalf of another individual or entity, you represent that you are authorized to accept these Terms on their behalf, and that such individual/entity agrees to indemnify Nosedive for any violation of these Terms by you.

1) Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law. By using the Site, you confirm that you meet these requirements.

2) Changes to the Terms

We may modify these Terms at any time. Changes are effective upon posting on the Site (or the date stated as effective). Your continued use of the Site constitutes acceptance of the updated Terms. Please review them periodically.

3) Scope & Commencement of Service

Your use of the Site and any services offered via the Site commences when you access, browse, purchase, create an account, or otherwise use the Site.

4) Ownership & Intellectual Property

The Site, its look-and-feel, text, graphics, logos, icons, images, video/audio, software, code, designs, product names (including Crashmate), trademarks and all other content (“Content”) are owned by or lawfully licensed to Nosedive and are protected by Indian and international IP laws.
Except as expressly permitted, you may not copy, reproduce, modify, adapt, create derivative works, distribute, transmit, display, perform, publish, or otherwise use any Content without our prior written consent.

5) Your Account, Security & Information

Some features may require an account. You must provide accurate and complete information, keep your password confidential, and are responsible for all activity under your account. Notify us promptly of any unauthorized use or security breach. We reserve the right to refuse, suspend, or terminate accounts at our discretion.

6) Acceptable Use

You agree not to:

use the Site for unlawful, harmful, fraudulent, infringing, or misleading activities;
upload or transmit viruses, malware, or harmful code;
attempt to gain unauthorized access or interfere with the Site’s operation;
copy, scrape, or harvest Content or user data except as permitted;
impersonate any person or entity or misrepresent your affiliation.

7) User Submissions (Reviews, Comments, Media)

If the Site allows you to post or submit content (“User Submissions”):

You retain ownership of your User Submissions, but grant Nosedive a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sub-licensable license to use, reproduce, adapt, publish, translate, distribute, display, and create derivative works in any media for operating, improving, promoting, and providing the Site and our products.
You represent that your User Submissions are original or you have all necessary rights; they must not be unlawful, defamatory, obscene, infringing, deceptive, or otherwise objectionable; and they must comply with these Terms and applicable law.
We may (but are not obligated to) monitor, moderate, remove, or disable access to any User Submissions at our discretion.

8) Products, Orders & Payments

Product Information: We strive for accuracy but do not warrant that product descriptions, images, pricing, inventory, or other content are error-free. We may correct errors, update information, or change product details without notice.
Orders: Placing an order is an offer to buy. We may accept or reject any order for any reason (including stock limitations, pricing errors, suspected fraud). If we cancel after payment, we’ll refund the amount received for that order.
Pricing & Taxes: Prices are in INR unless stated otherwise. Applicable taxes (including GST) and shipping charges are shown at checkout.
Invoicing: Tax invoices (with our GSTIN 27AAYFN0307R1ZI) will be issued for taxable supplies as per applicable law.
Payments: You authorize us and our payment partners to charge your selected payment method. You are responsible for applicable bank fees, conversion fees, and chargebacks.
Shipping & Delivery: Estimated timelines are indicative. Risk of loss passes to you upon delivery to the address provided.
Returns/Refunds/Warranty: Any return, refund, or warranty terms will be as per our Return & Warranty Policy (if published). Where not specified, statutory consumer rights (if applicable) apply.

9) Third-Party Services & Links

The Site may contain links to third-party websites or integrate third-party services (payment gateways, logistics, analytics, etc.). We do not control and are not responsible for third-party sites/services. Your use of them is at your own risk and subject to their terms and privacy policies.

10) Maintenance & Availability

We may perform maintenance, updates, or upgrades which could affect availability. We may suspend or restrict access without notice for maintenance, security, legal, or operational reasons.

11) Privacy

Our collection and use of personal data is described in our Privacy Policy (as available on the Site). By using the Site, you consent to our processing of your information as per that policy.

12) Indemnity

You agree to indemnify, defend, and hold harmless Nosedive, its partners, affiliates, officers, employees, agents, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site or products; (b) your User Submissions; (c) your breach of these Terms or applicable law; or (d) your violation of any third-party rights.

13) Disclaimer

The Site, Content, and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. You use the Site at your sole risk.

14) Limitation of Liability

To the fullest extent permitted by law, Nosedive and its affiliates shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages (including loss of profits, data, or business) arising from or related to the Site, Content, products, or these Terms, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility. Our total aggregate liability for all claims shall not exceed the amount you paid to us for the product(s) giving rise to the claim in the 3 months preceding the claim, or INR 10,000—whichever is lower.

15) Termination & Suspension

We may, at our sole discretion and without notice, suspend or terminate your access to the Site (in whole or part) for any reason, including suspected violations of these Terms or applicable law. Upon termination, your right to use the Site ceases immediately; Sections intended to survive (including IP, indemnity, disclaimers, limitations, governing law, etc.) will survive.

16) Transfer & Assignment

We may assign or transfer our rights and obligations under these Terms (including as part of a merger, acquisition, restructuring, or sale of assets). You may not assign or transfer your rights or obligations without our prior written consent.

17) Compliance & Disclosures

We may disclose information if required by law, regulation, legal process, or governmental request, or to protect our rights, users, or the public.

18) Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to any applicable arbitration/conciliation laws (if we introduce them in a future policy), the courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms or your use of the Site.

19) Miscellaneous

Headings are for convenience only and do not affect interpretation.
If any provision is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver of any term shall be deemed a continuing waiver.
These Terms (together with the Privacy Policy and any posted policies like Return & Warranty Policy) constitute the entire agreement between you and Nosedive regarding the Site and supersede all prior communications.
